The New Mexico state attorney’s general has reached a settlement in a case involving auto dealerships that were accused of violating the states Unfair Practices Act, according to the Associated Press.
The suit, which was filed in March 2005 against Zangara’s Albuquerque and Espanola dealerships, alleged that they consistently overcharged customers for vehicle registration and title fees and charged them a fictitious fee to guarantee titles.
The injunction prohibits the dealerships from charging customers more than the Motor Vehicle Division fee for vehicle licenses and registration and from charging a “title guarantee fee” unless no title exists.
In addition, the dealerships must also set up an account, which will be administered by a third party, that will pay restitution to customers for the fees. The administrator will contact people who bought a vehicle from Zangara Dodge or Zangara de Espanola after Jan. 1, 2000.
