U.S. District Judge Aleta Trauger has ruled that dealers’ markups of the wholesale loan rates charged by Primus discriminate against minority buyers. She ordered both sides to propose solutions.
The “business justification” proposal differs from previous settlements in which plaintiffs’ lawyers have gotten lenders to cap the permissible percentage point markup of wholesale interest rates.
Primus told Automotive News this proposal will cost the company business by prompting dealers to use other financing sources that require less paperwork.
