PIERRE, S.D. -- The South Dakota Supreme Court has ruled that the state Revenue Department and the court system have authority to interpret tax laws, such as the excise tax on vehicle sales, reported The Associated Press. Dan Nelson Automotive Inc., which filed for bankruptcy in June, asked for a ruling on how the tax should be applied when vehicles are returned or repossessed.
The high court unanimously said a circuit judge can decide how the excise tax should be applied in cases where a financed vehicle is repossessed or returned to a dealer before it is completely paid for.
