Auto dealerships should not have to set a limit on the amount charged for preparing paperwork despite demands from legislative leaders, said the Arkansas Motor Vehicle Commission.
The commission voted 6-2 against the law authorizing a cap, which will be sent back to the Arkansas Legislature, reported the Arkansas Democrat Gazette.
Dennis Jungmeyer, president of the Arkansas Automobile Dealers' Association, told the paper, “This is a fee, it's legitimate, it's legal, it's a way for dealers to recoup part of their operating expenses.”
The cap is part of the debate about “documentary” fees, which are not included in the advertised price but are later added during the sale. The current law allows dealers to charge a fee for the cost of “preparing, handling and processing documents” involved in the sale of vehicles.
